Abstract
The article is an analysis of the death penalty aspects of the first Öcalan v Turkey ECtHR case. It is argued that the European Court of Human Rights has erred in using Article 3 to find a violation against Turkey while Article 2 protecting the most fundamental right of all, the right to life, should have been relied on instead.
